In addition, some members maintained that in referring to the consular notification cases (La Grand and Avena), by way of illustrating the point that the "unclean" hands of the individuals concerned played no role in diplomatic protection, the Special Rapporteur was employing too vague a conception of the clean hands doctrine because he failed to examine the relationship between the unlawful act of the individual and the internationally wrongful act of the State.
