If the Commission arrives at the conclusion that, in situations of State succession, the right to a nationality, or at least some of its elements, belong to the realm of lex lata, it should examine the question whether the above-mentioned obligation to negotiate can indeed be considered to be a corollary of such right and whether it can be deduced from the general principles applicable to State succession.
